【主旨】

 

  台端函詢有關為營業而購買之商品發生糾紛，可否適用消費者保護

  法乙案，本會意見如說明二，請　查照。

 

【說明】

 

  一、復　台端八十七年九月二十九日函。

 

  二、民眾購買商品，如其目的主要供執行業務或投入生產使用，並非單

      純供最終消費使用者，核與消費者保護法第二條有關消費者及消費

      關係之定義未合，尚無消費者保護法之適用，惟仍有民法及其他相

      關法規之適用。
